As 2022 comes to a close and the world gets back to business as usual, we are seeing an increased demand from artists who are in need of an artist visa to come back to the U.S. to perform and record.
However, although it seems like the pandemic is behind us, foreign nationals are still experiencing delays at U.S. embassies and consulates around the world. This is mainly due to the government not completely dealing with the backlog that has persisted over the past two years and it doesnât seem there is any end in sight to getting visa appointments back on a pre-2020 track.
Outside of exercising Premium Processing, which is a costly option and only speeds up the process on the domestic side of immigration, what is the best solution? APPLY EARLY!
USCIS regulations permit visa applicants to file their O-1 or P-1 Visa application within 6 months of their first gig. What does this mean? If you plan on performing in the US on June 1, 2023, or sooner, you can apply RIGHT NOW. Applying as early as possible is the best, most cost efficient, and least stressful way to deal with the consular delays. It will provide the best chances to ensure that a visa is in hand well before you book the flight to the US.
But being timely is half the battle. You must make sure to have updated reference letters praising your accomplishments, significant press articles, evidence of past shows, and signatures on all future contracts/deal memos lined up to avoid or minimize the chances for a Request for Evidence (RFE).
